Lets say its a BP situation, two players playing at two tables and a BP that is called in for positive counts. The BP cannot see the two spotters playing without looking suspicious. Would it be legal for the spotters to call the BP with a cell phone? Obviously he wouldnt answer the phone and the spotters wouldnt pull out their phone, they would just call the person from their pocket. However it is allowed to use your phone at the table.

What are your thoughts on this? Is this considered "using a device"?

We do this all the time. That does not mean that if a casino really wants to be a dick they won't try to harass you any way they can.

I disagree. I think this clearly falls under Nevada Revised Status 465.075 unlawful to use a device to assist in keeping track of cards played. maybe someone with a legal background can correct me if I'm wrong.

The cell phone wouldnt inform the BP to the count, other ways would be used. The phone would just be used to signal when the BP should start making his way towards the table. Would this still be considered using a device to keep track of cards played?

The device isn't being used to keep track of the cards, it's used to communicate existing information to someone else. That's why I think it's legal, and could be easily defended by a competent attorney.

But they can still bring you to court over it if they wanted to harass you.

I wouldn't want to be the defendent in the case, since first offense is minimum 1 year imprisonment. IN the show las vegas (james cann) they arrested a guy and girl for doing just that and claimed it was using a device to aid in counting. Of course I do realize that was just television. Surely there must have been a real actual case of this nature. anyone know anything more definate?

In our case it provides absolutely no information other than "come to the table". I don't see how that could possibly be considered illegal. If I text my wife to come to a table is that ok? I think they would be arresting a lot of people if that were the case. Also, since your BP doesn't even have to answer the call, now it is illegal to call someone even if they don't answer?

I say it's legal. I hear guys call up a friend and say "hey come on over to this table" all the time. The "device" we are actually using to get the advantage is still our brain.

They might theoretically try to charge you with wire fraud for using a telephone to conspire to cheat a casino, but I don't think any casino is lucky enough to get a Federal judge to buy that.

My BJ buddy and I use our cellphones all the time to call each other to tables. One thing we do is one of us "keeps talking" for a little while after the other hangs up, just to make it a little more difficult for them to put 2 + 2 together.

I say not illegal, and gosh do i see a stack of phone toting maniacs at tables all the time.

Phones are good for lots of stuff, Good potential for cover plays and of course offer some wicked wonging opportunities.

I say not illegal, but you could get the wrong judge. Definitely, DEFINITELY wouldn't do it, though.

If you do do it, and you're using text messages, keep your phone below the table so the eye can't read your phone.
