The state has no jurisdiction, but the tribe can't just elect not to pay. Are they claiming a machine malfunction?

Interesting that the news story doesn't even mention a reason. Instead, it says "The machine indicated he hit the jackpot, but casino workers ushered him into a room and told him he wouldn't be paid."

I would assume they claimed it was a malfunction, but who knows?

Default wrong filing place

That attorney needs to go BACK to law school for sure ! THEY are a sovereign nation and you need to go through the BIA - bureau of indian affairs - and they will then direct you to the federal court where he can file. If he was cheating or something he is really screwed as that is a federal offense committed on an Indian reservation . Keep us posted

I'm curious, if Indian casinos can cheat, and it's not illegal because it's a sovereign nation, can we go on Indian reservations and do whatever we want, and not be prosecuted unless they catch us? Seems like you should be able to rob them if they can cheat you...

If you don't get caught by the casino you are pretty much in the home clear. If you get caught you are totally fooked. They could essentially do what-ever they deem appropriate.

So, I could get 20 people together with guns, and go rob an Indian casino, and that wouldn't be a federal or state offense, only a crime in that sovereign nation?
