Backing off and banned

I hope it never happens to me...but just in case it does...


If you are ever backed off or barred from BJ, how long does it last? For life? Is being backed off vs. "barred" have different lengths of time where it's safe to visit a store again?

I am not an attorney (but I did stay at a Holiday Inn Express last night...:laugh:) In a 'backoff' you are only limited from playing blackjack. You do not have to leave the property, so there is no time limit involved. In a 'barring' you kicked off the property and are suppossedly prohibited from returning to the property at any time in the future. I say supposedly, because the 30 year old Wilkinson Case in nevada seems to indicate there is no validity to a tresspass. The judge indicated that even though the defendent had been tresspassed, that she still had to be given the opportunity to leave upon returning, pretty much making a tresspass meaningless. This doesn't appear to have been challenged, again, at least to my knowledge, in the past 30 years, so the casinos just continue to use it as a intimidation tactic, but it really has no legal standing. So the way I see it, the only way you can really be permanately barred, is if you are well enough known that as soon as you sit down, they refuse to let you play, even if you are playing unrated. I would be interested in hearing the opinions of someone with a legal background.

Now the above situation applies only to Nevada. In New Jersey as we all know, there are not able to remove a player for winning. But of course they employ other countermeasures. With the opening of venues in other eastern states, we should look into what the legal policies in those states are.

According to my lawyer; if you get barred, and the casino later sends you any promotional material, or an invitation to any event, then you'll have a good legal argument that the barring has been rescinded. The good news is; these places often don't know their right hand from their left. I've gotten several of these offers after I've been barred. I DO save these, just in case I ever need them.

If it ever happens that I get arrested at any of these places, I probably WILL file a lawsuit for false arrest; and I'll keep everyone posted!

Quite a few years ago I was tossed from my room and tresspassed by a very evil casino. I had committed the high crime of hole carding.
About three weeks later I received an invite from these evil folks offering me a free stay plus an entry into a slot tourney, food and other incentives and I took them up on their offer. I also booked a more friendly casino just in case and made many copies of the invite and their email confirmation.
After a few hours in the casino (not playing blackjack) I was approached by a suit and two goons (security types), and told that I should leave immediately or be arrested for misdemeanor tresspass. I gave the suit a copy of the invitation and sarcasticly stated, "I thought this was your way of saying sorry for mistreating me." He told me to stay put and left his two friends as my bodygaurds.
He returned about 15 minutes later and told me I was welcome to stay and play as long as I did not play any table games.
A few days after returning home I received a certified letter that stated that I was again tresspassed and it made it clear that this included all property owned by these evil company.
My point is that for me this whole little adventure was kind of fun and I was willing to put up with some hassle or even an arrest for a minor infraction that had no way of standing up in court. Perhaps stupid on my part but with their inviting me back, I never even thought it would get to the point that I even needed a lawyer if they pulled the tresspass and Metro was strupid enough to follow through.

So, yes you might land up with a law suit or just have some suits running around trying to figure out why no one talks to marketing, but most people really do not want any kind of hassle and would avoid returning at all.
By the way, not only did I not play table games as told but played nothing there, they paid my food, room and I was a $500 prize in the tourney

A barring and a back-off are not "that" big a deal, if you get a legal notice of tresspass that is a big deal and far better for you to stay away. If you do go back be prepared for the consequences.:eek:
