Is playing at an online casino legal in India?

Since 1 May 2026, online money games, meaning real-money casino play, betting and wagering, are banned across India. Offering them, advertising them and processing payments for them are criminal offences, and the ban reaches operators based outside India. Here is what that means before you play.

India changed its answer in 2025. The Promotion and Regulation of Online Gaming Act 2025, in force since 1 May 2026, bans online money games outright: real-money casino play, betting and wagering. Every online casino that takes Indian players is licensed offshore and offers exactly what the Act now prohibits. The penalties fall on the operators who run these games, the sites that advertise them and the banks and apps that move the money, not on the individual player, but the rails you would use to deposit and cash out are being actively shut off. The Act is also under challenge in the Supreme Court, so this position could still change.

Will you get in trouble for playing from India?

The Act's offences are written for the operators who run online money games, the sites that advertise them and the banks and apps that move the money, and there is no penalty on the ordinary player and no evidence of a recreational player being prosecuted for simply playing. But do not read that as a green light. The real, current risk to a player is money: payment providers are barred from handling these transactions, deposits are being blocked and accounts frozen, and no Indian law protects you if an offshore casino refuses to pay.

The ban is new. Is it settled, or could it change?

The Act is in force, but its constitutional validity is being challenged in the Supreme Court, which was hearing the case in early August 2026 with no stay granted as of this review. A ruling could narrow or uphold the law, so this page states the position as it stands today and is dated accordingly.
