Indian casino doesn't want to pay 1.6 mil jackpot....

Interesting that the news story doesn't even mention a reason. Instead, it says "The machine indicated he hit the jackpot, but casino workers ushered him into a room and told him he wouldn't be paid."
I would assume they claimed it was a malfunction, but who knows?

That attorney needs to go BACK to law school for sure ! THEY are a sovereign nation and you need to go through the BIA - bureau of indian affairs - and they will then direct you to the federal court where he can file. If he was cheating or something he is really screwed as that is a federal offense committed on an Indian reservation . Keep us posted

I meant get caught by the Indian tribe. Or would the feds come after you.
If you don't get caught by the casino you are pretty much in the home clear. If you get caught you are totally fooked. They could essentially do what-ever they deem appropriate.

Suppose you were to get 20 people together and rob a bank in Mejico. Would that be a federal or state offense? But the Feds and the state would happily arrest you and extradite you back to the scene of the crime.

they still have to obey usa law, because indian reservations are not their own country, despite whatever title they are given.. otherwise, indian casinos could kill you for cheating, deal drugs, and other such things.. btw, rigging the machines to cheat you is not usa law, but rather law of the gaming commission, which does not oversee indian casinos unless they choose to be overlooked, which i believe most do

i dont believe cheating is a federal offense, but im not sure; i believe everything besides regular crimes go thru the gaming commission

obviously mexico would handle the situation, or they would extradite you back to the usa.. you said federal or state, but do you mean for mexico or here? i dont think mexico has states, and if you meant here, it would be federal, since you are being extradited

Unfortunately it's mostly a one-way street. Contrary to popular belief US criminal law applies on all Indian reservations and they're generally required to submit to state law as a condition of being recognized as a tribe. Members of the tribe have the option of seeking justice among themselves in a tribal court, but as US citizens they also have access to US courts. They also have special exemptions to law for themselves, such as for religious drug use. But if you as a paleface commit a crime at an Indian casino you can expect to be arrested and tried under state law.
Civil cases are a different story and if you try to sue an Indian casino you won't get anywhere. So this guy isn't going to get his money unless the casino decides the bad press is going to cost them more than $1.6M, and I doubt that. Beware of these operators- they're not as skilled or interested in catching AP's as Nevada casinos are, but if they do catch you you're more likely to encounter someone who out of sheer ignorance considers you a cheater and refuses to pay you or harms you in some other way.
I had this idea to get markers in Indian casinos and not pay them back based on the theory that no court that has jurisdiction over the debt will be able to collect it from me. But they way they do it is with a check guarantee- I have to write them a check for the amount and if I don't pay they will deposit the check, and if it bounces they can come after me in state criminal court for writing a bad check.

The article wasnt detailed enough, but my guess is that this is a 1.6 million dollar progressive, anyone? So why do they care, dont progressives collect money from everyone on that network contributing to the game? Or is this just a case of "once we get the money from the network, we dont plan on paying you"....meaning they really aren't out 1.6 million, they just want to hijack it.
I guess if they put up the 1.6 million themselves i see why they are being A-holes. If its a network progressive, thats a great way to lose all your customers. :cool2:

The machine in question was not a progressive. It stated on the pay table that the top payout at max coins was $2500. Somehow,the machine malfunctioned and a screen popped up saying " Jackpot Winner",and went on to state that he had won $1,6000,000plus.
Seems like the Indians have a strong case.
