Why nothing changes in Utah
There is no legislative drama to chart here, because the door is locked at a level ordinary bills cannot reach. Utah’s prohibition lives in Article VI, Section 27 of the state constitution, so legalizing even a single lottery ticket would take a two-thirds vote of both legislative chambers followed by a statewide referendum. That has never happened, and with the state’s strong cultural opposition to gambling it is not close to happening. Sports-betting and lottery bills that sail through in other states do not even get filed here in a form that could pass. For the foreseeable future, Utah stays a zero-gambling state, and the offshore casinos above remain the only online option.
Taxes on winnings in Utah
Offshore casinos send no tax forms, but your winnings are still income. The IRS counts every dollar as taxable whether or not a W-2G is issued (Rubrique 419 de l'IRS), and Utah taxes it again at its flat 4.45% income-tax rate (Utah State Tax Commission). Utah’s flat-tax system does not itemize gambling losses, so unlike the federal return there is no state offset for a losing session; the win is taxed and the loss is yours.
The federal side tightened in 2026. Under the Loi « One Big Beautiful Bill », only 90% of gambling losses are deductible federally, and still only up to your winnings. Break even over a year and you can still owe federal tax on the slice the new rule no longer lets you write off. Repeal efforts are in Congress; the 90% cap is the 2026 rule.
The takeaway: keep session records. Dates, deposits, withdrawals, results. With no casino paperwork coming and no state loss offset, your own log is the only paper trail there is.
