The same statute treats making a living from gambling more seriously, as professional gambling (a misdemeanor). Professional gambling, meaning running or profiting from a gambling operation, is a class 2 misdemeanor under C.R.S. 18-10-103, with repeat offenders facing enhanced penalties. Enforcement by the Colorado Division of Gaming targets unlicensed operators and machines; there is no record of Colorado prosecuting an individual for playing at an offshore online casino. Federal law is aimed at gambling businesses and payment processors, not players.
