One legal betting app. And it is not a casino.

Florida is one of the stranger gambling maps in the country. There is legal online wagering here, but it lives entirely inside a single app, Hard Rock Bet, run by the Seminole Tribe. That is a deliberate arrangement. The 2021 gaming compact between the tribe and the state handed the Seminoles statewide exclusivity over online betting through 2051, so no other sportsbook, and no online casino at all, is licensed to take a Florida bet.

The compact survived a long court fight. A federal judge threw it out in late 2021, a federal appeals court put it back in 2023, and in June 2024 the US Supreme Court declined to hear the challenge, which locked the Seminole monopoly in place. So when Floridians see Hard Rock Bet advertised and assume the rest of the online-casino world must be legal too, they are reading it backwards. The exclusivity that makes Hard Rock Bet legal is the same thing that keeps DraftKings, FanDuel and every licensed online casino out.

Hard Rock Bet is a sportsbook. It does not offer real-money online slots or blackjack, because Florida has never legalized internet casino games for anyone, tribe included, off tribal land. So a Floridian who wants to play real-money blackjack or slots from their couch has no in-state option, and the offshore casinos below are what fills that gap.

Why offshore casinos?

How we check these casinos for Florida

Every offshore casino publishes a list of US states it refuses, and no two lists match. Bovada blocks twenty states; BetOnline blocks exactly one; Red Dog blocks only Kansas and Michigan. Florida sits on none of them, but we confirm it casino by casino rather than assume:

  1. Read the terms. We open each casino’s current terms and conditions, find its restricted-states list, and check that Florida is absent.

Gambling law in Florida: what is actually legal

Florida allows tribal casinos, a state lottery and a tribe-run sportsbook, but online casino play is not among the things the state permits.

Will you get in trouble for playing online from Florida?

Playing a game of chance for money is a second-degree misdemeanor under Fla. Stat. 849.08, punishable by up to 60 days and a $500 fine. Running the game is the serious end: keeping a gambling house (Fla. Stat. 849.01) and bookmaking (Fla. Stat. 849.25) are felonies. Enforcement targets operators, illegal machine rooms and unlicensed cardrooms, not individual bettors; there is no record of Florida prosecuting anyone for playing at an offshore online casino. Federal law points the same way, since the UIGEA targets gambling businesses and payment processors, not players.

How Florida got here

Florida’s betting story is really the story of one compact and the lawsuits around it.

2018

Voters pass Amendment 3, handing themselves the sole power to authorize new casino gambling and making any commercial-casino expansion a statewide-referendum question.

2021

Governor DeSantis and the Seminole Tribe sign a 30-year compact; the legislature ratifies it, launching statewide online sports betting through the tribe.

2021

A federal judge vacates the compact weeks after Hard Rock Bet launches, and the app goes dark. Struck down

2023

A federal appeals court reinstates the compact and Hard Rock Bet relaunches across Florida, the only legal online sportsbook in the state.

2024

The US Supreme Court declines to hear the challenge in June, leaving the Seminole online monopoly standing through 2051.

Taxes on winnings in Florida

Here Florida gives you something back. The state has no personal income tax at all, so there is no state tax on gambling winnings, no state form, nothing to file at the state level. That is the opposite of a New York or California player’s position and one of the genuine perks of gambling from Florida.

Federal tax still applies. The IRS counts every dollar of gambling winnings as taxable income whether or not any paperwork changes hands (IRS Topic 419), and offshore casinos send no W-2G, so the record is on you. From the 2026 tax year the deduction math also tightened: under the One Big Beautiful Bill Act, only 90% of gambling losses are deductible, still capped at your winnings. Win $10,000 and lose $10,000 in the same year and you broke even at the table but still owe federal tax on $1,000.

The takeaway is the one every offshore player should hear: keep your own log. Dates, deposits, withdrawals, results. No casino paperwork is coming, so your record is the only paper trail you will have. The upside is that Florida asks for none of it.

Getting money in and out from Florida

No Florida law stops a deposit. The friction is your bank: an issuing bank can decline a gambling charge, which is routine and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
