Will you get in trouble for playing online from Idaho?
Taking part in gambling is a misdemeanor under Idaho Code 18-3802, carrying up to six months in jail and a fine of up to $1,000. Keeping or operating a gambling house or scheme carries heavier penalties under the same chapter (Idaho Code 18-3801 et seq.). Enforcement by the Attorney General and Idaho State Police targets illegal operations and machines, not individual bettors, and there is no record of Idaho prosecuting a person for playing at an offshore online casino. Federal law is aimed the same way, since the UIGEA targets gambling businesses and payment processors, not players.

Taxes on winnings in Idaho
Offshore casinos send no tax forms, but the winnings are still income. The IRS treats every dollar as taxable whether or not a W-2G exists (Rubrique 419 de l'IRS), and Idaho taxes it again through its flat income tax, which for 2026 sits at 5.3% after a cut under HB 40 in 2025 (Idaho State Tax Commission). One flat rate on every dollar of winnings.
On losses, federal law tightened in 2026. Under the Loi « One Big Beautiful Bill », only 90% of gambling losses are deductible federally, capped at your winnings. Win $10,000 and lose $10,000 and you can still owe tax on $1,000. Repeal bills are pending, but the 90% rule is the law for 2026.
The takeaway: keep session records. Dates, deposits, withdrawals, results. With no casino paperwork coming, your own log is the only paper trail you will have.
Getting money in and out from Idaho
No Idaho law stops a deposit. The friction is your bank: a card issuer can decline a gambling charge, which is routine and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
