New Hampshire does gambling its own way. Its online sports betting runs through a single operator, DraftKings, which struck a revenue-share deal with the state lottery for an exclusive contract, so there is no FanDuel or BetMGM here, just the one app. And its casinos are not commercial casinos at all: they operate under charitable-gaming law, offering blackjack, roulette and poker with 35% of the take going to New Hampshire nonprofits. Since 2021 they have added machines that look and feel like slots, called historical horse racing terminals.
What none of that includes is a legal online casino. The lottery runs sports betting and online lottery games but no internet slots or blackjack, and a 2025 bill to license iGaming was tabled in committee. So the DraftKings app has no casino tab in New Hampshire, and the charitable rooms are floor-only.
So a New Hampshirite who wants to play real-money online slots or blackjack has no legal in-state way to do it. The offshore casinos below are what fills that gap.

Under RSA 647:2 gambling as a player is a violation, the lowest tier of offense (a fine, not a crime), and the statute carves out charitable gaming, licensed sports wagering and small private poker games. Making gambling a business under RSA 647:2 is a misdemeanor, and the state can move to shut an operation down by injunction and forfeit its equipment. Enforcement runs through the Lottery Commission's charitable gaming division and the Attorney General, aimed at operations rather than individual players; New Hampshire may enjoin an unlawful gambling business through the courts. There is no record of the state prosecuting a person for playing at an offshore online casino. Federal law is aimed the same way, since the UIGEA targets gambling businesses and payment processors, not players.

This is the rare good-news tax section. New Hampshire has never taxed wages, and the one income tax it did have, on interest and dividends, was repealed effective 1 January 2025 (New Hampshire Department of Revenue Administration). The upshot for a player: New Hampshire imposes no state income tax on gambling winnings at all. There is no state layer to worry about here, only the federal one.
Federal tax still applies. The IRS treats every dollar of gambling winnings as taxable income whether or not a W-2G is issued (Rubrique 419 de l'IRS), and offshore casinos issue none, so the record is yours to keep. On losses, federal law tightened in 2026: under the Loi « One Big Beautiful Bill », only 90% of gambling losses are deductible federally, capped at your winnings. Break even over a year and you can still owe federal tax on the slice the new rule no longer lets you deduct.
The takeaway: keep session records for the federal side. Dates, deposits, withdrawals, results. New Hampshire will not ask, but the IRS can.
No New Hampshire law stops a deposit. The friction is your bank: an issuing bank can decline a gambling charge, which is routine and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
