South Carolina’s core gambling ban is one of the oldest in the country. Section 16-19-40, written in 1802, makes it a crime to play “any game with cards or dice” in almost any building, from a tavern to a store to a private house used for gaming, with a penalty of up to 30 days. It is broad enough that, read literally, a friendly home poker night breaks it. That is not a hypothetical: in Town of Mt. Pleasant v. Chimento in 2012, the state Supreme Court held the statute reached a Texas Hold’em game played in a private home.
So on paper, South Carolina is one of the strictest states there is. In practice the 1802 law is an antique that gets pointed at machines and organized operations, not at people. The last time the state truly went to war with gambling was over video poker: by the late 1990s the machines were everywhere, and the legislature shut the entire industry down effective 1 July 2000, pulling roughly 33,000 machines out of gas stations and bars almost overnight. That fight, not the card table, is what South Carolina’s enforcement history is really about.
The one thing voters did approve came right after: a 2000 constitutional amendment cleared the way for the South Carolina Education Lottery, which sold its first ticket in 2002 and remains the only legal gambling in the state.

South Carolina's gambling law reaches the player. Section 16-19-40, on the books since 1802, makes playing any game with cards or dice in almost any building a misdemeanor punishable by up to 30 days. The state Supreme Court applied it to a private home poker game in Town of Mt. Pleasant v. Chimento (2012). Setting up or keeping a gaming table is a separate and more serious offense under Sections 16-19-10 and 16-19-20. The 1802 law is a genuine antique and is not turned on people playing online. Enforcement in living memory has centered on illegal machines, most famously the video-poker industry the state shut down in 2000. There is no record of South Carolina prosecuting anyone for playing at an offshore online casino. Federal law points the same way, since the UIGEA targets gambling businesses and payment processors, not players.

The earliest realistic window. Sports betting alone might pass by statute, but casinos would need a constitutional amendment and a statewide vote.
Offshore casinos issue no tax forms, but the winnings are still taxable. The IRS counts every dollar of gambling winnings as income whether or not a W-2G exists (IRS Topic 419), and South Carolina taxes it too. The state overhauled its income tax in 2026: under H 4216, signed on 30 March 2026, the rate is 1.99% on the first slice of taxable income and 5.21% above it, down from a former top of 6%. So a South Carolina player’s winnings face a top state rate of 5.21% on top of federal tax.
Losses can be set against winnings, but the federal deduction narrowed in 2026. Under the One Big Beautiful Bill Act, only 90% of gambling losses are deductible, still capped at your winnings. Break even over a year and you can still owe tax on the losses federal law no longer lets you write off.
The takeaway: keep session-level records. Dates, deposits, withdrawals, results. With no casino paperwork coming, your own log is the only record you will have.
No South Carolina law stops a deposit. The friction is your bank: a card issuer can decline a gambling charge, which is common and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
