No. The Criminal Code's gambling offences target the people who run and profit from gambling, not their customers, and no Canadian has ever been prosecuted for playing at an offshore online casino. What you give up is protection, not legality: no Canadian regulator stands behind these sites, and nothing about being offshore obliges a casino to pay you, which is exactly why our ratings are built on casinos we have cashed out from ourselves. In Ontario and Alberta you also have a regulated alternative, sites registered with the province, where a Canadian regulator hears your complaint.

The practical risk is protection rather than prosecution, which is why we only list casinos we have withdrawn from ourselves.
A gaming regulator that has licensed online casinos from the Mohawk Territory of Kahnawà:ke, near Montreal, since 1996, which makes it one of the oldest online gaming regulators anywhere. Its authority comes from the community's asserted right to conduct gaming from its own territory rather than from the Criminal Code's provincial system; no Canadian law recognises it and no court has struck it down. Plenty of casinos open to Canadians hold a Kahnawake licence, but like every offshore licence it is not a Canadian consumer protection, and our ratings rest on our own testing rather than on the licence.
Not as a recreational player. The Canada Revenue Agency treats gambling winnings as windfalls, which are not taxable income, and that covers the ordinary player at any casino, provincial or offshore. The exception is gambling carried on as a business: a professional who plays for a living can be taxed on the proceeds. Interest earned on winnings after you receive them is taxable like any other interest.
Those two provinces license private casino sites, so players there have a regulated alternative where the provincial regulator hears complaints and enforces its standards. The casinos on this page are licensed offshore instead, and those protections do not travel: wherever you play from, your real protection at an offshore site is the operator's record of paying, which is what our ratings measure.
