Will you get in trouble for playing online from West Virginia?

Licensed apps report qualifying wins to the IRS on a W-2G, so the income is on record whether or not you file for it. All gambling winnings are taxable federally (Tema 419 del IRS) and under West Virginia’s graduated income tax, where the top rate has fallen to 4.58% for 2026 after several rounds of cuts (West Virginia Tax Division).
Federally, from the 2026 tax year only 90% of gambling losses are deductible against winnings under the Ley «One Big Beautiful Bill», so you can break even on the year and still owe tax.
