Montana runs plenty of legal gambling, but it keeps it close to home. Video gambling machines and small-stakes card rooms live in bars and taverns across the state, tribes run casinos under compacts, and the only sportsbook is a lottery-run kiosk you have to stand in front of to bet. What the state does not license is any online casino, so there is nothing state-regulated for us to recommend. Taxes on winnings in Montana
Offshore casinos issue no tax forms, but the winnings are still income. The IRS counts every dollar as taxable whether or not a W-2G exists (Rubrique 419 de l'IRS), and Montana taxes it again through its income tax, which after the state’s recent overhaul runs on two brackets topping out at 5.9% (Montana Department of Revenue).
Losses are deductible only to a point now. From the 2026 tax year, under the Loi « One Big Beautiful Bill », only 90% of gambling losses can be deducted federally, and still only up to your winnings. Win $12,000 and lose $12,000 over a year and you are flat at the tables but can still owe tax on $1,200. Repeal efforts are in Congress; the 90% cap is the 2026 rule.
The takeaway: keep session records. Dates, deposits, withdrawals, results. With no casino paperwork coming, your log is the paper trail.
Getting money in and out from Montana
No Montana law stops a deposit at the payment level; the friction is your bank. A card issuer can decline a gambling charge, which is routine and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
