Montana is one of the rare states whose law reaches the individual online player: taking part in illegal gambling is a misdemeanor under MCA 23-5-161, and SB 555 leaves that player-level exposure in place while making operators felons. Running or promoting an illegal online gambling enterprise is a felony under SB 555, reaching up to $50,000 in fines and 10 years in prison per offense. In practice the Gambling Control Division of the Montana Department of Justice pursues operators and illegal machines, not individual players, and there is no record of Montana prosecuting someone for playing at an offshore online casino. But Montana's statute is genuinely stricter on paper than most states, so this is one place the letter of the law is worth knowing. Federal law is narrower still: the UIGEA targets gambling businesses and payment processors, not players.

Most states aim their gambling laws squarely at operators and leave the individual player alone. Montana is one of the exceptions. Taking part in illegal gambling is a misdemeanor under MCA 23-5-161, and SB 555, the 2025 law that made running online gambling a felony, left that player-level exposure sitting right where it was. So on paper, a Montanan placing a bet at an offshore casino is closer to the line than a player in, say, Georgia or Ohio.
What the paper says and what actually happens are two different things. The Gambling Control Division of the Montana Department of Justice goes after operators and illegal machines, and there is no record of Montana charging someone for playing at an offshore online casino. Federal law is narrower still: the UIGEA targets gambling businesses and payment processors, not the people betting. We are not telling you the sky is falling. We are telling you Montana’s law is one you should actually know, because it is written differently from most, and pretending otherwise would not be doing you any favors.

Losses are deductible only to a point now. From the 2026 tax year, under the Legge "One Big Beautiful Bill", only 90% of gambling losses can be deducted federally, and still only up to your winnings. Win $12,000 and lose $12,000 over a year and you are flat at the tables but can still owe tax on $1,200. Repeal efforts are in Congress; the 90% cap is the 2026 rule.
The takeaway: keep session records. Dates, deposits, withdrawals, results. With no casino paperwork coming, your log is the paper trail.
