When voters approved it in 1990, they tied it to three old mining towns, Black Hawk, Central City and Cripple Creek, plus two tribal casinos in the southwest corner. That limit is written into the state constitution (Article XVIII), which is why an online-casino law is not just a bill away: expanding casino gaming beyond those towns would take a statewide vote, not a simple act of the legislature.

Why offshore casinos?

How we check these casinos for Colorado

Will you get in trouble for playing online from Colorado?

Placing a bet is a class 1 petty offense under C.R.S. 18-10-103, carrying a fine up to $300 and up to ten days in jail. The same statute treats making a living from gambling more seriously, as professional gambling (a misdemeanor). Professional gambling, meaning running or profiting from a gambling operation, is a class 2 misdemeanor under C.R.S. 18-10-103, with repeat offenders facing enhanced penalties. Enforcement by the Colorado Division of Gaming targets unlicensed operators and machines; there is no record of Colorado prosecuting an individual for playing at an offshore online casino. Federal law is aimed at gambling businesses and payment processors, not players.

How Colorado got here

Colorado has legalized gambling in careful, voter-approved steps, and each one has drawn a tight boundary around what comes next.

1990

Voters approve limited-stakes casino gaming, but only in Black Hawk, Central City and Cripple Creek. The three-towns model is written into the constitution.

2019

Proposition DD passes by a razor-thin margin, legalizing sports betting and steering the tax toward the state water plan.

2020

Sports betting goes live in May across online apps and the casino sportsbooks. Online casino games are not part of it.

2020

Voters pass Amendment 77, letting the three towns raise or drop their own bet limits and add games. Casino gaming stays inside those towns.

2026

No online-casino bill has moved. Because the constitution ties casino gaming to the three towns, adding it online would take another statewide vote.

Taxes on winnings in Colorado

Offshore casinos send no tax forms, but that does not make winnings invisible. The IRS counts all gambling winnings as taxable income whether or not a W-2G exists (IRS Topic 419), and Colorado adds its flat 4.4% state income tax on top (Colorado Department of Revenue). The rate is the same for everyone, though in strong revenue years the state’s TABOR rules occasionally trim it a notch at filing time.

Losses used to offset winnings fully if you itemized. From the 2026 tax year that changed: under the One Big Beautiful Bill Act, only 90% of gambling losses are deductible federally, still capped at your winnings. Win $10,000 and lose $10,000 in the same year and you broke even but still owe federal tax on $1,000.

The practical takeaway: keep session-level records. Dates, deposits, withdrawals, results. With no casino paperwork coming, your own log is the paper trail you will have.

Getting money in and out from Colorado

No Colorado law stops a deposit. The friction is your bank: an issuing bank can decline a gambling charge, which is routine and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
