How we check these casinos for Texas
Offshore casinos write their own US state rules, and no two match. Bovada refuses twenty jurisdictions, BetOnline one, Red Dog two (Kansas and Michigan), and several name no state at all. Texas is on none of those lists, but we confirm it casino by casino:

The Texas Constitution tells the legislature to prohibit gambling, and the Penal Code carries that out. Only the lottery, charitable bingo and charitable raffles are carved out.

The Texas Lottery has run since 1992. SB 3070, signed 20 June 2025, abolished the standalone Texas Lottery Commission effective 1 September 2025, moved lottery and charitable-bingo oversight to the Texas Department of Licensing and Regulation, and banned lottery courier apps.

No authorizing statute, and a 2016 Attorney General opinion (KP-0057) called paid daily fantasy contests illegal gambling. The major operators kept serving Texas players and the state has not moved to stop them.

Will you get in trouble for playing online from Texas?
Placing a bet is a Class C misdemeanor under Texas Penal Code 47.02, the lowest criminal tier, punishable by a fine and no jail; the statute even provides a defense for gambling in a private place where no one profits from running the game. Running a game is far more serious: gambling promotion (Penal Code 47.03) and keeping a gambling place (Penal Code 47.04) are Class A misdemeanors, and engaging in gambling as a business can rise to a felony. Enforcement targets operators and illegal game rooms, not individual bettors; there is no record of Texas prosecuting anyone for playing at an offshore online casino. Federal law points the same way: the UIGEA targets gambling businesses and payment processors, not players.
Texas has said yes to gambling twice, both times decades ago, and no every time since. The pattern is the point.

Taxes on winnings in Texas
Here Texas gives something back. The state has no personal income tax at all, so there is no state tax on gambling winnings, no state form, nothing to file at the state level. That is the opposite of a New York or California player’s position and one of the few genuine perks of gambling from Texas.
Federal tax still applies. The IRS counts every dollar of gambling winnings as taxable income whether or not any paperwork changes hands (IRS Topic 419), and offshore casinos send no W-2G, so the record is on you. From the 2026 tax year the deduction math also tightened: under the One Big Beautiful Bill Act, only 90% of gambling losses are deductible, still capped at your winnings. Win $10,000 and lose $10,000 in the same year and you broke even at the table but still owe federal tax on $1,000.
The takeaway is the same one every offshore player should hear: keep your own log. Dates, deposits, withdrawals, results. No casino paperwork is coming, so your record is the only paper trail you will have. The upside is that Texas asks for none of it.
Getting money in and out from Texas
No Texas law stops a deposit. The friction is your bank: an issuing bank can decline a gambling charge, which is routine and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
