South Dakota does have casinos, but it decided decades ago exactly where they could be. Voters wrote limited-stakes gaming into the state constitution and pinned it to the old mining town of Deadwood, and later did the same with sports betting, which is legal only if you place the wager inside Deadwood or on tribal land. What the constitution never authorized is any casino you can reach from your own home, so there is no state-regulated online casino for us to recommend. The casinos above are offshore: they operate from outside the US, mostly under Curacao or Panama licenses, and they take South Dakota players because they sit outside the state’s reach.
That comes with a genuine trade-off, and we would rather name it than bury it. If an offshore casino treats you badly, no US regulator will step in. Engaging in gambling the state has not authorized is a low-level offense for the individual under SDCL 22-25-1. Running an internet gambling business is the serious crime: a Class 6 felony for a first offense under SDCL 22-25A-10, rising to a Class 5 felony after that. Enforcement targets illegal operators and machines, not players, and there is no record of South Dakota prosecuting anyone for playing at an offshore online casino. Federal law is aimed the same way, since the UIGEA targets gambling businesses and payment processors, not players.

Taxes on winnings in South Dakota
Here is the rare piece of good news. South Dakota has no state personal income tax, a limit built into its constitution, so unlike almost every other state on this site it takes no cut of your gambling winnings at the state level (South Dakota Department of Revenue). That does not mean the money is untaxed, only that the tax is entirely federal.
And the federal side is real.
