Texas is the biggest prize in American gambling that nobody can unlock. Thirty million people, no legal casino app, and a legislature that keeps the door bolted. So the real-money play that happens here happens offshore: at casinos that run from outside the US, mostly under Curacao or Panama licenses, and that can take Texas players because no Texas law reaches them.
We would rather name the trade-off than paper over it. If an offshore casino treats you badly, no US regulator will pick up the phone. The operator’s own record is your protection, which is why payout history and dispute handling weigh so heavily in our reviews, and why we run a complaints desk on every review page and chase unresolved cases with the casino ourselves.
It is also why this list rewards age. Vegas Casino Online has paid US players since 1999, Bovada since 2007, BetOnline since 2004. Every offshore casino publishes a list of US states it will not serve, and those lists are all different. Bovada blocks twenty states; BetOnline blocks exactly one; Red Dog blocks only Kansas and Michigan. Texas sits on none of them, but we confirm it casino by casino rather than assume:

Placing a bet is a Class C misdemeanor under Texas Penal Code 47.02, the lowest criminal tier, punishable by a fine and no jail; the statute even provides a defense for gambling in a private place where no one profits from running the game. Running a game is far more serious: gambling promotion (Penal Code 47.03) and keeping a gambling place (Penal Code 47.04) are Class A misdemeanors, and engaging in gambling as a business can rise to a felony. Enforcement targets operators and illegal game rooms, not individual bettors; there is no record of Texas prosecuting anyone for playing at an offshore online casino. Federal law points the same way: the UIGEA targets gambling businesses and payment processors, not players.

The earliest anything can move. Texas meets in regular session only every two years, and legalizing casinos needs a constitutional amendment: two-thirds of both chambers plus a statewide vote.
Here Texas gives something back. The state has no personal income tax at all, so there is no state tax on gambling winnings, no state form, nothing to file at the state level. That is the opposite of a New York or California player’s position and one of the few genuine perks of gambling from Texas.

The takeaway is the same one every offshore player should hear: keep your own log. Dates, deposits, withdrawals, results. No casino paperwork is coming, so your record is the only paper trail you will have. The upside is that Texas asks for none of it.
No Texas law stops a deposit. The friction is your bank: an issuing bank can decline a gambling charge, which is routine and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.

Playing at an offshore site is technically a Class C misdemeanor under Penal Code § 47.02, but that is the state’s lowest offense, it carries a private-place defense, and Texas has never charged an individual for online play. Enforcement targets operators.
No. DraftKings and FanDuel run real-money casino apps only in the states that license them, such as New Jersey, Pennsylvania, Michigan and West Virginia. In Texas those brands offer daily fantasy contests only, and even those run under a 2016 Attorney General opinion that called paid fantasy illegal.
