Virginia gave you almost everything except the casino app
Virginia bettors hit this wall a lot. The state legalized a whole slate of gambling in 2020: online sports betting went live in January 2021, and brick-and-mortar casinos have been opening ever since. DraftKings, FanDuel, BetMGM and Caesars all run legal sportsbooks here. But those are sports-betting licenses. Open the casino tab inside one of the same apps from a Virginia location and it is switched off, because the 2020 law did not include online casino games.
Virginia came close to fixing that in 2026. Two iGaming bills, HB 161 in the House and SB 118 in the Senate, each passed their own chamber. Then they died: the House and Senate could not reconcile their competing versions before the session ended on 14 March 2026, so nothing reached the governor. Online casinos remain illegal, and no state-licensed casino app exists to hold.
Until a future session finishes the job, a Virginian who wants real-money slots or online blackjack finds the sportsbooks and their in-state casino tabs closed to them. The offshore casinos below are what fills that gap.

Virginia regulates sportsbooks and casinos but not online casino play, so there is no state-licensed casino app to recommend. The casinos above are offshore: they run from outside the US, mostly under Curacao or Panama licenses, and they accept Virginia players because no state law reaches them.
The trade-off is real, and we would rather name it than bury it. If an offshore casino treats you badly, no US regulator will step in. Illegal gambling is a Class 3 misdemeanor under Va. Code 18.2-326, punishable by a fine of up to $500 and no jail time. Running an illegal gambling operation can be a felony under Va. Code 18.2-328. Law enforcement and the Virginia Lottery focus on operators and the regulated casino and sportsbook markets, not individual players; there is no record of Virginia prosecuting anyone for playing at an offshore online casino. Federal law points the same way, since the UIGEA targets gambling businesses and payment processors, not players.

Taxes on winnings in Virginia
Offshore casinos send no tax forms, but the winnings are still taxable. The IRS treats all gambling winnings as income whether or not a W-2G is issued (Rubrique 419 de l'IRS), and Virginia adds its state income tax on top, which tops out at 5.75% for most filers (Virginia Tax).
Losses can offset winnings, but not as fully as they used to. From the 2026 tax year, under the Loi « One Big Beautiful Bill », only 90% of gambling losses are deductible federally, still capped at your winnings. Win $10,000 and lose $10,000 in a year and you broke even at the tables but still owe tax on $1,000.
The takeaway: keep session-level records. Dates, deposits, withdrawals, results. With no casino paperwork arriving, your own log is the only trail you will have.
Getting money in and out from Virginia
No Virginia law stops a deposit. The friction is your bank: a card issuer can decline a gambling charge, which is routine and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
