Unlawful gambling is a violation, not even a crime, on a first offense under AS 11.66.200, becoming a class B misdemeanor only on a second or later offense. A 'player' in a genuine 'social game' has an affirmative defense (AS 11.66.280), but an offshore casino is not a social game. Promoting gambling is the real target: gambling in the first degree (AS 11.66.220) is a class C felony aimed at operators. There is no record of Alaska prosecuting an offshore online player; enforcement targets illegal operators. The first-offense player exposure is a violation, closer to a traffic ticket than a criminal charge. Federal law is aimed at businesses, not bettors, under the UIGEA.

A first offense of unlawful gambling under AS 11.66.200 is a violation, not even a crime, more like a traffic ticket than a charge; only a second or later offense rises to a class B misdemeanor. The code carves out a defense for a “player” in a genuine “social game” (AS 11.66.280), but an offshore casino, being a business that profits from the table, does not qualify. The serious weight is aimed at operators: gambling in the first degree under AS 11.66.220 is a felony.
In practice, there is no record of Alaska prosecuting anyone for playing at an offshore online casino, and the first-offense exposure is about as light as a gambling statute gets. Here is the good news. Alaska has no state personal income tax, so it takes no cut of your gambling winnings at the state level (Alaska Department of Revenue). That does not make the money tax-free; it means the only tax that applies is federal.
And the federal side is real. The IRS counts all gambling winnings as income whether or not a W-2G is issued (IRS Topic 419), and offshore casinos issue none, so the record is yours to keep. From the 2026 tax year, under the One Big Beautiful Bill Act, only 90% of gambling losses are deductible federally, still capped at your winnings. Break even over a year and you can still owe federal tax on the slice the new rule no longer lets you write off.
