Will you get in trouble for playing online from Michigan?

Playing at an MGCB-licensed app is fully legal at 21+. No Michigan statute targets an individual player for using an offshore site, and no player prosecutions are documented. Unlicensed operators are the target: the MGCB issues cease-and-desist orders against unlicensed online gambling operators, and did so against 45 offshore sites in a single 2026 sweep. Enforcement lands on operators, not players, and federal law agrees: the UIGEA targets gambling businesses and payment processors, not the bettor. Going offshore trades away every MGCB protection, which is the real cost.

How Michigan got here

Michigan moved slowly on casinos and then fast on the internet, going from a signed bill to a live market in barely a year.

1996

Voters approve Proposal E, allowing three commercial casinos in Detroit alongside the state’s tribal casinos.

2019

In December, Governor Whitmer signs the Lawful Internet Gaming Act and the Lawful Sports Betting Act, legalizing online casinos, poker and sports betting together.

2021

Online casinos and mobile sportsbooks go live on 22 January, making Michigan the fifth state with regulated online casino play.

2023

The MGCB begins its cease-and-desist campaign against sweepstakes casinos, treating the dual-currency model as unlicensed gambling.

2026

The Board issues cease-and-desist orders to 45 offshore operators in one enforcement sweep, one of the largest by any US regulator.

Taxes on winnings

Licensed apps report qualifying wins to the IRS on a W-2G, so the income is documented whether you file for it or not. All gambling winnings are taxable federally (IRS Topic 419) and Michigan taxes them at its flat 4.25% individual income tax rate through the Department of Treasury. Michigan does let residents deduct gambling losses against winnings on the state return, which is more generous than most states.

Federally, from the 2026 tax year only 90% of gambling losses are deductible against winnings under the One Big Beautiful Bill Act: break even at the tables and you can still owe federal tax. Offshore winnings come with no paperwork, so your own session log is the only record; the tax is owed regardless.

Is online gambling legal in Michigan?

Yes, fully. Online casinos have been legal and MGCB-regulated since the market launched on 22 January 2021, and online sports betting since the same day. You must be 21 or older and physically in Michigan while playing; the apps verify both.

What is the MGCB disassociated persons list?

It is Michigan’s lifetime self-exclusion list for the three Detroit commercial casinos: once you are on it, entering to gamble is a crime and any winnings are forfeited. You can apply for removal after five years. Online self-exclusion is handled separately through the state’s responsible gaming database, which every licensed app must check, so the two systems cover the floor and the internet respectively.
