California is the largest gambling economy in the country and still has no legal casino app. That is not an accident of a slow legislature; it is the result of a standoff. The state’s tribes hold a constitutional lock on Las Vegas-style gaming and have spent heavily to keep online operators out. Will you get in trouble for playing online from California?
California's gambling statute (Penal Code 330) targets people who deal, operate or profit from banked games rather than the individual bettor, and the sports-wagering statute (Penal Code 337a) works the same way. Operating an illegal banked game or bookmaking is a misdemeanor under Penal Code 330 and 337a, and from 2026 AB 831 adds specific misdemeanor liability for running or supporting a sweepstakes casino. Enforcement runs through the Attorney General and the Bureau of Gambling Control against operators and vendors, not players; there is no record of California charging an individual for playing at an offshore online casino.

Taxes on winnings in California
California is the other end of the scale from a no-income-tax state. It taxes gambling winnings as ordinary income, and its top marginal rate reaches 13.3%, the highest of any state (Franchise Tax Board). Most players sit well below that top bracket, but every dollar of winnings is state-taxable, and offshore casinos send no forms, so the record is yours to keep.
Federal tax stacks on top. The IRS treats all gambling winnings as income whether or not a W-2G exists (Tema 419 del IRS), and from the 2026 tax year only 90% of gambling losses are deductible federally under the Ley «One Big Beautiful Bill», still capped at your winnings. Between the federal change and California’s rate, a winning year here is taxed harder than in most of the country.
The practical move is simple: keep session-level records. Dates, deposits, withdrawals, results. With no casino paperwork coming, your own log is the only paper trail you will have.
Getting money in and out from California
No California law stops a deposit. The friction is banking: an issuing bank can decline a gambling charge, which is routine and not a legal issue. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
