But in March 2026 the legislature voted to send it to study, which in Beacon Hill terms is a polite shelving. The state’s own casino operators, worried about cannibalizing their floors, lobbied against it. So the study happened, the conversation started, and nothing became law.

Will you get in trouble for playing online from Massachusetts?
Massachusetts does not criminalize casual online play from home. MGL c.271, Section 2 reaches gaming for money in a public place or while trespassing, not a person betting privately on their own device, and even there the penalty is minor: a fine up to $50 or up to three months. The offenses that carry weight target operators: keeping a common gaming house and organizing gambling are punished under MGL c.271, Section 5 and the sections that follow. Enforcement, through the Gaming Commission's enforcement bureau and local authorities, targets operators and illegal gaming houses, not individual bettors; there is no record of Massachusetts prosecuting anyone for playing at an offshore online casino. Federal law points the same way, since the UIGEA targets gambling businesses and payment processors, not players.
Massachusetts built its gambling market carefully and late, and online casinos are the door it just decided not to open yet.
