Is it legal to play at an online casino in Kenya?

Yes, for you as a player. Kenya's Gambling Control Act of 2025 created a new regulator, the Gambling Regulatory Authority, and for the first time it can license online casinos. The Act's offences target operators, not their customers, so no Kenyan is prosecuted for playing at an offshore casino. The casinos on this page are licensed offshore rather than by the Gambling Regulatory Authority, so the trade-off is protection: if an offshore site refuses to pay, no Kenyan regulator can step in, which is why we only list casinos we have withdrawn from ourselves.

Did Kenya not just change its gambling law?

Yes. The Gambling Control Act of 2025 replaced the 1966 Betting, Lotteries and Gaming Act and the old Betting Control and Licensing Board with the Gambling Regulatory Authority. Most casino sites you will find still describe the old law and the old board; they are out of date. The new Act does allow online casino licences, but the established licensed market in Kenya is still overwhelmingly sports betting.

Do I pay tax on casino winnings in Kenya?

Kenya taxes gambling through licensed operators: an excise duty is charged on deposits and a withholding tax is deducted from winnings at licensed sites, collected at source and sent to the Kenya Revenue Authority. An unlicensed offshore casino does not deduct these, but that is not a benefit worth chasing: you also have none of the protection a licensed operator carries, and the tax rules have changed repeatedly, so treat any figure you read as needing a fresh check against the Kenya Revenue Authority.
