Sports betting, yes. Online casinos, studied and shelved.

Massachusetts turned on legal sports betting in early 2023, retail books first and mobile apps that March, and the FanDuel and DraftKings apps have been part of the furniture ever since. DraftKings is a Boston company, so the marketing here has been relentless. It is a short leap to assume the online casino next to the sportsbook must be legal too.

It is not. The 2022 law legalized sports wagering only. Massachusetts came closer than most in the last two years: a bill to authorize online casinos, H 4431, would have let Encore, MGM Springfield and Plainridge Park run online slots and table games, and it got a real hearing. But in March 2026 the legislature voted to send it to study, which in Beacon Hill terms is a polite shelving. The state’s own casino operators, worried about cannibalizing their floors, lobbied against it. So the study happened, the conversation started, and nothing became law.

That leaves a familiar split: a licensed sportsbook you can use and no legal online casino behind it. A Massachusetts player who wants real-money blackjack or slots has the casino tab closed inside the licensed apps, and the offshore casinos below are the fallback.

Why offshore casinos?

How we check these casinos for Massachusetts

Will you get in trouble for playing online from Massachusetts?

Massachusetts does not criminalize casual online play from home. MGL c.271, Section 2 reaches gaming for money in a public place or while trespassing, not a person betting privately on their own device, and even there the penalty is minor: a fine up to $50 or up to three months. The offenses that carry weight target operators: keeping a common gaming house and organizing gambling are punished under MGL c.271, Section 5 and the sections that follow. Enforcement, through the Gaming Commission's enforcement bureau and local authorities, targets operators and illegal gaming houses, not individual bettors; there is no record of Massachusetts prosecuting anyone for playing at an offshore online casino. Federal law points the same way, since the UIGEA targets gambling businesses and payment processors, not players.

How Massachusetts got here

Massachusetts built its gambling market carefully and late, and online casinos are the door it just decided not to open yet.

Taxes on winnings in Massachusetts

Offshore casinos send no tax forms, but that does not make winnings invisible. The IRS counts all gambling winnings as taxable income whether or not a W-2G exists (IRS Topic 419), and Massachusetts taxes them as income at its flat 5% rate.

High rollers face more. Under the 4% surtax that voters added to the state constitution in 2022, income above $1 million is taxed an extra four points, taking the top rate to 9% (Massachusetts Department of Revenue). A big win that pushes your total income over the million-dollar line is exactly the kind of thing that can trip the surtax, so a jackpot is worth modeling before you assume the 5% rate. On the federal side, from the 2026 tax year only 90% of gambling losses are deductible under the One Big Beautiful Bill Act, still capped at your winnings.

The takeaway: keep session-level records. Dates, deposits, withdrawals, results. With no casino paperwork coming, your own log is the only paper trail you will have.

Getting money in and out from Massachusetts

No Massachusetts law stops a deposit. The friction is your bank: an issuing bank can decline a gambling charge, which is routine and not a legal problem. Visa clears more often than Mastercard, and several of these casinos add 5 to 15% fees on card deposits. Cards also cannot receive a withdrawal.
